đ§ Know Your Rights at Protests and Rallies
Attending a peaceful rally or protest is a constitutional right protected by the First Amendment. You have the right to speak out, assemble, and demand changeâbut itâs important to know your rights and how to stay safe.
âď¸ Your Rights
You have the right to rally and protest in public spaces such as streets, sidewalks, and parks. You do not have the right to block public walkways, sidewalks, or private property. Some spots require a permit by event organizers. Some spots require a permit for loudspeakers by event organizers.
You can record police and public officials performing their duties, as long as you donât interfere.
You can rally or protest without being targeted for your race, religion, immigration status, or beliefs.
đ§° Before You Go
Bring photo ID, a charged phone, water, and snacks.
Wear comfortable, weather-appropriate clothing
Leave valuables, non-essential cards, and personal info at home.
Go with a buddy and plan how to reconnect if separated.
đ¨ If Youâre Stopped or Detained
Stay calm. Ask if you are free to leave. If yes, walk away calmly.
If youâre detained, ask, âAm I under arrest?â If yes, you have the right to remain silent.
Do not resist arrest, even if you believe itâs unlawful. You can challenge it later in court.
Document what happensârecord names, badge numbers, and time if possible.
You donât have to answer questions beyond giving your name and address if requested.
You do not have to consent to a search of yourself, your belongings, or your phone.
You can remain silent. If you choose to do so, say clearly, âI am exercising my right to remain silent.â
If arrested, ask for a lawyer immediately. Do not sign or say anything without legal counsel.

You still have First Amendment rights.
You do not have to answer questions about your citizenship status.
Carry your rights card if youâre worried about ICE presence.
