The second indictment of James Comey should alarm every American who cares about free speech and the rule of law. Federal prosecutors charged the former FBI director over an Instagram post showing seashells arranged as “86 47,” which the government claims was a threat against Trump. Comey denies violent intent, says he opposes violence, and his defense has raised First Amendment concerns.1 He said he came across the shells while walking on a beach and wanted to share the image he found with his followers. Another question also arises: Does “86” mean “get rid of,” as in remove from office, or is the government trying to frame it as something more nefarious?
This is bigger than Comey. Trump’s executive order NSPM-7 directs the Joint Terrorism Task Forces to investigate, prosecute, and disrupt people and groups accused of political violence, but its language reaches into ideology, protest, advocacy, and dissent. Civil liberties groups have warned that the memo points to vague “indicators” like anti-capitalism, anti-Christianity, views on migration, race, and gender, and hostility to “traditional” views. Where does legitimate dissent end and political violence begin, and who gets to decide when free speech is being turned into a threat?
Let us be clear: real threats and political violence should be taken seriously. But a democracy cannot survive when a president blurs the line between actual violence and protected speech, protest, donations, organizing, or criticism. The ACLU warns that the executive order could target nonprofits, donors, and activists under the banner of domestic terrorism, and recent reporting on FBI domestic terrorism investigations tied to anti-ICE activity shows how quickly this machinery can spread.
If Congress funds NSPM-7, it risks funding an infrastructure of political repression. Today it may be a former FBI director. Tomorrow it could be an immigrant rights group, a racial justice organizer, a reproductive freedom advocate, a faith leader, a journalist, a student protester, or a neighbor holding a sign. The right to dissent is not terrorism.
