We generally send one People Power United newsletter each day. But for members who want to go deeper on the issues they care about most, we also publish focused newsletters exploring specific topics, including our work to expose ICE abuses and hold power accountable.
I’m sharing today’s newsletter from that publication so you can get a feel for what we cover. ICEbreaker News exposes ICE abuses, detention, surveillance, and state violence while demanding accountability and action for immigrant communities.

Power to the People!
ICE’s detention system is expanding while courts, federal watchdogs, lawmakers, and communities raise new questions about how people are arrested, how long they can be detained, the conditions they face, and how billions of taxpayer dollars are being spent.
This week, a federal watchdog documented costly problems in ICE’s rapid detention expansion. A federal judge imposed permanent protections at a New York detention facility. Hundreds of federal judges have rejected the government’s broad interpretation of mandatory detention, an issue that may soon reach the Supreme Court. And senators introduced legislation that would establish new warrant and custody-review requirements. At the same time, ICE continues exploring new detention models and facilities across the country.
When government authority expands, due process, transparency, independent oversight, and accurate public information become increasingly important.
When Detention Expands, Accountability Has to Keep Pace
ICE Detention Expansion Lost Millions to Abandoned Plans
A federal watchdog found that ICE’s rapid push to expand detention capacity resulted in millions of dollars in unrecoverable costs. ICE spent about $1.07 billion purchasing 11 warehouses intended for detention use, but the agency now plans to sell seven of them. The review identified $20 million in unrecoverable costs tied to warehouses the government no longer plans to use and warned that further losses are possible. PBS
Why we are watching:
Congress has provided enormous resources for immigration detention. The Government Accountability Office concluded that stronger planning is needed to reduce additional waste. Oversight of those expenditures matters because decisions involving billions of public dollars affect both immigration enforcement and the federal budget.
Judge Imposes Permanent Protections at New York Detention Site
A federal judge issued a permanent injunction requiring changes at the immigration holding facility inside 26 Federal Plaza in Manhattan. The court found that detainees had been held for excessive periods in overcrowded conditions and had faced inadequate sanitation, food, medical care, and meaningful access to attorneys. The ruling requires ICE to meet continuing standards at the facility. ACLU
Why it matters:
Temporary holding facilities are still subject to constitutional and legal requirements. Court orders can establish enforceable standards governing conditions, medical treatment, sanitation, and access to counsel when agencies fail to meet those requirements.
Supreme Court Could Take Up ICE Detention Without Bond
A major legal dispute is developing over the administration’s interpretation of mandatory immigration detention. More than 500 federal judges have ruled against the administration in roughly 20,000 cases, while nine of 11 federal appeals courts considering the issue have rejected ICE’s broad interpretation. The Supreme Court is considering whether to hear a case that could determine when immigrants arrested inside the United States are entitled to bond hearings. The Marshall Project
The bigger issue:
Bond hearings allow a judge to determine whether continued detention is warranted while an immigration case proceeds. A Supreme Court ruling could significantly clarify how federal immigration law applies to people who entered the country without authorization but have lived inside the United States for extended periods.
Democratic Senators Introduce New Arrest and ICE Detention Standards
Senators Dick Durbin and Alex Padilla introduced legislation that would change procedures governing some ICE arrests and detention decisions. The proposal would generally require an administrative warrant supported by probable cause, require a bond hearing within 24 hours after a warrantless arrest, and establish periodic custody reviews for people remaining in immigration detention. Why we are watching:
The legislation adds another branch of government to the growing debate over arrest standards and prolonged detention. Its introduction does not change existing law, but it puts questions about warrants, bond hearings, and continuing custody directly before Congress.
💔 Why This Matters
This week’s stories are about more than immigration enforcement numbers.
They are about what rules govern government power once someone has been arrested and detained.
A watchdog needs access to spending records. A detainee needs adequate medical care and a way to speak privately with an attorney. A judge needs the government to comply with court orders. Congress needs accurate information when deciding how agencies should be funded and what legal standards they must follow.
And the public needs to know what is happening.
The government has substantial authority to enforce immigration law. That authority also operates within statutory, constitutional, budgetary, and judicial limits. This week, all four were part of the national conversation as courts reviewed detention practices, investigators examined spending, and lawmakers debated arrest procedures.
Oversight is how those competing responsibilities are tested in public.

Colorado Court Demands Records on Warrantless Arrests
A federal court ordered ICE to produce documentation involving 29 warrantless arrests that the court said were conducted without first documenting a flight-risk assessment. The judge warned that ICE could be found out of compliance with an existing preliminary injunction if it failed to provide the records. Courthouse News Service
ICE Examines Mobile Detention Facilities
Documents reviewed by reporters show ICE is considering what it calls mobile detention facilities in Pennsylvania, described as vans that could follow enforcement teams making arrests. The reporting also found more than $7 billion in detention-construction contracts signed during the week. ICE did not respond to questions about standards governing how mobile detention would operate. KERA News
San Antonio Warehouse Detention Center Moves Forward
Federal officials continue plans to convert a nearly 640,000-square-foot San Antonio warehouse into a detention facility capable of holding as many as 1,500 people a day. ICE purchased the building for $66.1 million and later awarded a $17.3 million contract for renovation and operational services. The facility is now expected to open this winter. Texas Public Radio
👀 What We’re Watching
The Supreme Court and mandatory detention:
The Court could decide whether to hear a case concerning ICE’s interpretation of mandatory detention. The eventual outcome could clarify when people arrested inside the country are entitled to seek release through a bond hearing.
ICE detention spending:
Federal investigators have warned that rapid expansion without sufficient planning creates additional financial risk. We are watching how ICE responds to the watchdog’s recommendations and what happens to facilities the agency purchased but no longer intends to use.
Conditions inside detention facilities:
The permanent injunction at 26 Federal Plaza establishes specific standards in one facility. Other litigation around the country continues to examine detention conditions, attorney access, and government compliance with court orders.
New detention infrastructure:
ICE continues pursuing additional detention capacity, including traditional facilities, converted properties, and possible mobile units. Communities, courts, Congress, and watchdog agencies will continue determining what oversight applies to those projects.

This week reminded us that accountability can come from many places: courts examining detention conditions, auditors tracking taxpayer dollars, lawyers defending due process, lawmakers questioning agency power, and journalists and communities documenting what is happening.
The underlying question remains:
What safeguards remain when government power expands?
Courts review government action. Congress writes laws and controls funding. Watchdogs investigate agencies. Attorneys protect legal rights. Journalists help make government actions visible.
These institutions may disagree, which is why reliable information, transparency, and due process matter.
Accountability is not one investigation or court ruling. It is the continuing work of asking questions, demanding records, examining evidence, applying the law, and making government decisions visible to the people.
Staying informed helps us understand what is happening and decide how we want to respond.
